GM Sues LendingTree Over Domain Name Use
General Motors has filed suit against mortgage firm LendingTree of North Carolina in U.S. District Court in Flint, Mich., to keep the mortgage firm from promoting its services on a domain name nearly identical to one owned by GM mortgage-lending subsidiary General Motors Acceptance, which uses the acronym GMAC.
LendingTree owns the domain realestate.com and the sub-domain .realestate.com, meaning any word placed before the sub-domain links users to the company's Web site.
GM registered the domain name gmacrealestate.com in 1999.
GM claims that LendingTree has acquired the rights to its domain name "to capitalize on and profit from the substantial goodwill that GM has developed in these trademarks...and to mislead the public and consumers."
