PUBLIC POLICY UPDATES


HOUSE SUBCOMMITTEE REAUTHORIZES TERRORISM INSURANCE BILL
Early this month, the House Financial Services Committee voted to extend the federal government's terrorism risk insurance program for another 15 years. The present program is set to expire at the end of this year. The passage of H.R. 2761 would help maintain a strong commercial real estate market and the health of the nation's economy by ensuring that terrorism insurance coverage is both available and affordable, according to the National Association of REALTORS®. NAR commended the passage of a reauthorization bill and called for a quick Senate vote when Congress returns to session. For more, visit this webpage.

TAX CHANGE WOULD CUT PARTNERSHIP PROFITS
A proposed tax law change could have an adverse impact on the income of general, or operating, partners in most real estate partnerships. The bill, H.R. 2834, would eliminate the currently favorable tax treatment for certain types of carried interest. NAR is working to ensure that real estate partnerships are exempt from any new rule modifying the treatment of carried interest as capital gains. Read more.

STUDY: IMPACTS AND OUTCOMES OF DERIVATIVES
Thanks to the development of several new indexes to track commercial property performance, investors will soon be able to purchase derivatives based on commercial real estate, according to a white paper from the REALTORS® Commercial Alliance. Before derivatives, commercial property investors had no way to manage risk in their commercial real estate portfolios without actually transacting in the physical market, the report states. PREMISES LIABILITY TOP CONCERN OF PROPERTY MANAGERS
Premises liability--particularly slip-and-fall accidents and conditions of a tenant's property--topped the list of liability concerns for the real estate managers responding to NAR's 2007 Legal Scan survey real estate management legal issues. The biannual Scan tracks legal cases and damage awards in the real estate industry and surveys practitioners on the lawsuits they're concerned about. This was the first time that the Scan has treated management concerns as a separate category from residential real estate issues. View the scan. (Login required)
