FIN CEN TAKES A LOOK AT COMMERCIAL REAL ESTATE LENDING
The Department of Treasury's Financial Crimes Enforcement Network (FinCEN) released a report that analyzed suspicious activity reports (filed by financial institutions to FinCEN) and found that commercial real estate reports are on the rise. The reports referenced the involvement of property management companies, development companies, real estate investment firms, real estate agents and title companies.
The report concludes that the increase in suspicious activity likely stems from the strong commercial real estate market -- it is unclear whether activity will decline if the market cools.
NAR Regulatory affairs will meet with FinCEN officials in January to discuss the report in more detail and explore ways that NAR and Treasury can work together to address some of the issues raised in the report.

NAR URGES REPRESENTATIVES TO SUPPORT EXTENSION FOR ILC MORATORIUM
On November 16, 2006, NAR sent a letter to the full House of Representatives urging Members to sign onto a letter initiated by Congressman Paul Gillmor (R-Ohio) and Congressman Barney Frank (D-Mass) asking the FDIC to extend the industrial loan company (ILC) moratorium, which is set to expire on January 31, 2007. Wal-Mart, Home Depot and a number of other commercial companies have taken steps to own ILCs, which is a special type of federally insured state-chartered bank. The Gillmor-Frank letter argues that the 110th Congress needs more time to debate the industrial loan company issue and consider closing the ILC loophole by prohibiting any commercial firms from directly or indirectly controlling an industrial bank. NAR believes that allowing ILCs to mix banking and commerce creates risks to the financial system, raises inevitable conflicts of interest, and harms the industry's competitive landscape. FORECAST HEALTHY FOR COMMERCIAL REAL ESTATE
The commercial leading indicator for brokerage activity rises again in third quarter. David Lereah, NAR's chief economist, said the index is at the highest level in the series of the indicator, which goes back to 1990. "Although we have a strong uptrend in the commercial sectors, the rise in the index over the last two quarters shows a lower rate of expansion in comparison with late 2005 and early 2006," Lereah said. "This means that commercial sectors will continue to grow, but at a more modest pace." Read more.

Effectively assessing and managing property-related risk is a major concern that cuts across all sectors of the professional real estate community.
