A 5-Step Approach for Handling Sexual Harassment Complaints

Having grievance procedures in place may help you resolve a sexual harassment complaint before it gets to court.

1. Get competent legal advice if you have any questions about what to do when an employee reports an incident of sexual harassment.

2. Investigate the allegations promptly. Interview witnesses and gather evidence. In a small company, the broker might investigate a complaint. In a larger company, investigators might include other managers, both male and female.

3. Keep the investigation confidential to protect reputations.

4. Make a decision. A determination about the merits of a complaint should be made at the highest level. In some cases, it's up to the broker.

5. Take prompt remedial action, and let the victim know what steps were taken.

TIP: Talking to the offending party is usually enough to stop unacceptable behavior, but don’t forget to document the conversation. —Doug Hinderer, vice president of human resources for the NATIONAL ASSOCIATION OF REALTORS®.
