Patent Reform

Efforts now are underway to reform U.S. patent law in response to growing concerns that the current patent system is unable to deal with challenges presented by the ever growing number of patent applications being submitted and increasing complexity of the technology for which a patent is being requested.

  • On June 5, the White House announced an initiative to curb the use of patents by patent holders as a tool for "frivolous litigation," and to protect "Main Street retailers, consumers and other end-users of productions containing patented technology."

  • NAR Associate Counsel Katie Johnson discusses how members can respond to letters that allege a violation of a patent for emailing scanned documents.

  • On February 27, Reps. Peter A. DeFazio (D-Ore.) and Jason E. Chaffetz (R-Utah) introduced HR 845 Known as the SHEILD Act. This legislation is intended to reduce litigation by “patent trolls” by making them liable for alleged infringers' court costs and attorneys' fees if their patents are found invalid or not infringed.
