The National Association of REALTORS® believes that the right to private property is an essential condition for the operation of our free enterprise system and a primary principle of the social contract upon which our democratic system of government relies for legitimacy. As a result, NAR is the leading advocate for private property rights in America and passionately advocates for the right to freely purchase, own, use and transfer real property. Any erosion of this protection, real or perceived, is cause for serious alarm.

NAR joined other groups to file a brief in a U.S. Supreme Court case that concerns due process rights of home owners caught in an EPA wetlands dispute.

Smart Growth Program and Resources

NAR supports land use regulations that strike a fair and reasonable balance between private property rights and community interests. NAR's Smart Growth Program encourages REALTORS® to play an active role in the evolution of their communities and provides a variety of resources on a variety of topics related to eminent domain, including zoning, growth management, and transportation.
